1 - Agreement between Client and Vivement Marrakech !

This web site and our booking service is made available to you conditioned upon your acceptance of the terms set forth below. By accessing or using the Dar Layyina web site and by renting the full property with us, you agree to be bound by these Terms and Conditions. These Terms and Conditions apply equally to the Group Leader and to all the persons named in the Booking Form (Client or Occupant)


2 – Vivement Marrakech ! Service

Dar Layyina is a registered trademark owned by Vivement Marrakech! Vivement Marrakech! provides a web site and a service to book rooms or the entire property. 

You are fully responsible for the purchase and the organization of your transportation to the rental property. You are also fully responsible to check and comply with local regulations regarding passport and visas as well as health requirements. Please contact your local office for foreign travel and passports to enquire about passport, visa and health requirements for the country in which the property is situated.

For our UK clients, the Foreign & Commonwealth Office Travel Advice Unit may have issued information about your holiday destination. You are advised to check their web site under "travel advice" or by telephone on 0845 850 2829. Alternatively, you can check the ABTA Travel Information website or by telephone on 0901 201 5050 (calls are charged at 50p a minute).
It is a condition of booking that you take out adequate travel insurance. As a minimum this should include cover for third party liability, vacation rental and medical repatriation. Your electronic validation of the booking form will be treated as confirmation that every member of your party has such insurance.

Reservation 

 

The booking price per night is displayed on the website on the base of number of rooms booked. The booking price is net of tax and includes the VAT of 10%, breakfast and all the included services mentioned on the Website. A communal tax of stay of 2,5 € per night and per person , as well as the tax of tourist promotion of 1€ per night and per person are not included to the rate of the property. These taxes are completely transferred to the Commune of Marrakech and the Moroccan National office of Tourism.

 

Vivement Marrakech! will confirm the client reservation upon payment of the guarantee deposit of 50% of the price of the stay by bank transfer to the  account of Vivement Marrakech! and acceptance by the client of the present Terms and Conditions, the Rental Conditions, the Reservation Conditions and the Cancellation Conditions. All these conditions are displayed on the web site. A confirmation of the client reservation will be sent to the client by email.

 

Upon arrival, the client will have to show his confirmation of reservation as well as his passport. The number and the name of the persons will have to perfectly match to the persons named in the booking form. Full payment of the balance as shown on the confirmation invoice is due 15 days prior to your arrival. If the payment is not received at the point stated in the Reservation Conditions, we reserve the right to cancel your booking and levy cancellation charges as detailed in the Cancellation Conditions. The booking price does not include optional incidentals or on-request items which will be added to the client final bill. On request services will be billed to the client by Vivement Marrakech! during the stay. On site payment of the balance of the stay can be made with the following payment method : Cash or credit card payment.

Cancellation or modification of a reservation

 

Any cancellation or modification of confirmed reservation can be done on the initiative of the Client in a written form to darlayyina@gmail.comin a reasonable time before the entry into rental period. Vivement Marrakech! can not make any guarantees to the Client's satisfaction of his claim rebooking.

 

Should the client need to cancel his booking after confirmation, he must immediately advise us in writing to darlayyina@gmail.com. The date of the email will be the one taken into account to calculate the amount of the cancellation fees. 

  • Cancellation occurs more than 7 days to arrival day : 50 % of total amount of reservation is due.

  • Cancellation occurs less than 7 days to arrival day : 100 % of total amount of reservation is due

  • In the case of early departure, whatever the reason, the whole price of the stay is due.

  • No show : 100 % of total amount of reservation is due

 

Occupancy

 

We reserve the right to terminate the Client’s stay without notice if we discover that the number of persons staying at the property exceeds the number stated on the confirmation email and the Client has not gained our prior written permission for this and/or paid any extra associated costs. In this situation, no refunds will be made and we will have no further responsibility to the client.

Guests: the Client will have to inform Vivement Marrakech! or its representative about any persons, he’d like to invite the latest the day before their arrival. Information about the identity of the guests will be required and may be checked. Vivement Marrakech ! or its representative is entitled to deny access to the property. 

Behavior

 

We expect all clients to have consideration for other people. If in our reasonable opinion, the Client or any member of his party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate the stay of the person(s) concerned. All bookings are assumed to be for normal holiday purposes only, and the Client agrees that the use of the property will be limited to this purpose. If the Client is planning to hold an event, such as a wedding or party, which involves having a larger number of people at the property, he will have to communicate this to Vivement Marrakech! at the time of booking, as special approval or arrangements may be required. Depending on the nature of the event, a surcharge and/or additional security deposit may be required, which will be agreed and confirmed in writing prior to confirming the reservation.

 

Safety - Equipment

 

Swimming pools by their very nature carry their own inherent risks. You must ensure that you and all members of your party take great care when using or being near any swimming pool(s) at the property where you are staying. You should for example make sure you and all members of your party are aware of the depth(s) and layout of the pool prior to use and that all persons walk rather than run around or near the pool. Children must be supervised at all times by a responsible adult.At all times, you and your guests are to consider your own safety and the safety of others when using the wellness area. Use of the wellness area is at your and your guests own risk. Facilities are to be used for the designed purpose and in compliance with the instructions given by the staff of the property . Without prejudice to the generality of the above, the following things are strictly prohibited in the wellness areas :- running;- diving or jumping into the swimming pool or Jacuzzi;- drinking of any alcohol or using the wellness area when under the influence of alcohol or drugs;- leaving children unsupervised in the wellness area.The direct, visual and active supervision of children present in a wellness area or by a swimming pool by an adult is essential and under your sole responsibility. The swimming pool, Jacuzzi etc located in the property do not comprise an alarm system, safety nets or other safety measures designed to prevent the risk of drowning. To ensure the safety of children, the following precautions must be taken, in particular:- never leave young children alone near the swimming pool or Jacuzzi;- never leave a child alone in the water, even if they know to swim, or in a hammam, steam room, sauna etc. They must always be under the supervision of an adult capable of saving them in the event of an accident;- never leave toys or other items floating on the water; they may encourage children to approach the water; and- always fit inflatable armbands of floating costumes on young children.If you fail to comply with the rules and security precautions set out in these Conditions, the staff of the property shall be entitled to prohibit the use of the wellness area or the swimming pool for the duration of your stay.

 

Energy

Vivement Marrakech! will not be accountable for any disturbance in electricity or Internet supply that is not linked to the propertIt is reminded that the distribution of water depends on the electricity supply.

The Client is expected to use normally and reasonably the light, heating and air conditioning equipment.  

House staff

 

During the stay, house staff is at the disposal of the Client, everyday from 7h to 23h with breaks during the day.

Meal times:
- Lunch: from 12 p.m to 14.00 p.m.
- Snacks: in the afternoon ideally around 16.30 -17h30
- Dinner: from 19 p.m to 21.00 p.m.

`Dishes have to be chosen the day before as our food is fresh of the day.
You can buy  wines and spirit to enjoy at home.

Morrocan law

 

The consumption of drugs and prostitution are strictly forbidden and severely punished by the Moroccan law. Any extramarital relationship of a foreigner with a Moroccan women or men, even free, is strictly forbidden. Should this situation occur, the person(s) concerned will be required to leave the accommodation. We will have no further responsibility toward such person(s). No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.

Intellectual property

 

The Client is allowed to take pictures at the scene of the leased property but has no right of commercial exploitation and publication of these photos in any medium whatsoever.

 

Data protection

 

Vivement Marrakech! Vivement Marrakech! undertakes not to disclose the personal information of its customers with the exception of information required for treatment, payment or cancellation of the booking.

 

Applicable law

 

These Terms and stays will be made subject to Moroccan law. In case of dispute for an amicable solution should be a priority, sought. Unless the courts of Marrakech (Morocco) will have exclusive jurisdiction. In case of conflict between different versions of conditions of sale, which is the version available on the site Dar Layyina prevail.
