Please read carefully these terms and conditions applicable to private rentals at Dar Layyina.

Preamble
These terms and conditions determine the rights and obligations of the parties in relation to the use of the website www.darlayyina.com for the private rental of the Dar Layyina estate.
The Client refers to any person who books or stays at Dar Layyina.
Users of the website www.darlayyina.com declare that they have read and expressly accepted these terms and conditions.

Services provided by Vivement Marrakech! and customer responsibility
Dar Layyina is a registered trademark of the company Vivement Marrakech!
The company Vivement Marrakech! offers a guest house and private rental service at the Dar Layyina estate with luxury hotel service for leisure stays in Marrakech.
The company Vivement Marrakech! does not under any circumstances offer its Customers transport to their holiday destination. The Customer therefore remains solely responsible for arranging their own transport to their holiday destination, as well as for the travel documents, health documents and insurance necessary for their trip. The Customer must comply with all local police, customs and health formalities. Useful information can be found on the following websites: http://diplomatie.gouv.fr.
The Customer is obliged to take out insurance with a solvent insurance company against the risks of theft, fire and water damage, both for risks related to their stay and for rental risks and those relating to the furniture furnishing the rented property. It is the Customer's responsibility to check that their insurance policy covers, in particular, the risks associated with seasonal rentals in France or abroad. The Customer may take out cancellation insurance and/or holiday insurance including civil liability and damage to the house.

Acceptance of the Terms and Conditions
It is the Customer's responsibility to carefully read all the terms and conditions relating to their stay, as specified on the website www.darlayyina.com. The Terms and Conditions of Rental, Booking, Modification and Cancellation are displayed on the website www.darlayyina.com. They are reproduced in full during the booking process, before the Customer confirms their booking.
The Customer is irrevocably bound by the booking commitment they have just made as soon as they pay the deposit for their booking in accordance with the terms set out in the Booking Terms and Conditions and using their chosen payment method. These General Terms and Conditions then apply without restriction to their booking.

Reservation
The rental price communicated on the website is the price per night depending on the period. This price includes accommodation for exclusive use and the services mentioned on the website. This price includes 10% VAT. It does not include the municipal tourist tax of €2.50 per night per person and the tourist promotion tax of €1 per night per person. These taxes are paid in full to the Municipality of Marrakech and the Moroccan National Tourist Office. The price does not include extras and customary tips for staff. To obtain a personalised quote, the customer must complete and validate the booking form on the website www.darlayyina.com or send a request by email to darlayyina@gmail.com.

Services included
Accommodation, house staff (excluding kitchen staff), breakfast, concierge service, 1 swimming pool (11m x 11m), 1 heated swimming pool (9m x 4m), private floodlit pickleball court (rackets and balls available to borrow), private, floodlit 3-on-3 basketball court, private, floodlit pétanque court (boules available to borrow), table tennis table (rackets and balls available to borrow), outdoor fitness pergola, Bluetooth speakers, fibre optic internet - WiFi, linen, deckchairs and bath towels, pool heating, energy consumption (excluding hammam and sauna heating), satellite TV programmes, baby equipment (cot, high chair), bathroom essentials.

Extra services
Meals, drinks (excluding wine and spirits), airport transfers, car with driver, hammam heating (€50 per day), sauna heating (€25 per day), massages and treatments, activities and excursions, customary tips for staff.
Payment terms
All bookings are confirmed by payment of a deposit equal to 50% of the rental price via a secure credit card payment link or bank transfer to the Vivement Marrakech! account, and by acceptance of the general terms and conditions of sale, rental conditions, booking conditions and cancellation conditions.
All these conditions are explained on the website and in a holiday rental contract sent to the customer by email, to be returned completed and signed to darlayyina@gmail.com.
The remaining 50% balance is payable on arrival at the villa by credit card or cash. If the balance of the rental price is not paid on the date of arrival, for any reason whatsoever, Vivement Marrakech! reserves the right to cancel the booking and apply the clauses detailed in the cancellation policy.
An indicative price is given on the website www.darlayyina.com for additional or optional services invoiced by Vivement Marrakech during the stay (meals, massages, hammam, sauna). These services will be invoiced according to their consumption by the Customer, added to their final invoice paid on site at the end of the stay or paid during the stay depending on the type of service concerned. Payment methods accepted on site during your stay: Credit card - Cash. Activities provided by service providers (transfers, activities, excursions) are to be paid directly to the service provider.

​​​​Cancellation or modification of a booking
Requests for changes or cancellations to bookings must be sent by email to darlayyina@gmail.com. In the event of a modification, Dar Layyina will do its utmost to satisfy you within the limits of availability. Vivement Marrakech! cannot under any circumstances guarantee that its Customer's request for a booking modification will be satisfied.
Cancellation received more than 30 days before the arrival date: 0% of the total amount of the booking is due.
Cancellations received between 0 and 30 days before the arrival date: 50% of the total amount of the booking is due.
In the event of early departure from the rental property for any reason whatsoever, the Customer may not request a reduction in the rental price, which shall remain in full payment to Vivement Marrakech!
No-show: 50% of the total amount of the booking is due.
Arrival and departure
Check-in time is from 2pm. (If there are no guests arriving before, early check-in is possible). Check-out time is 12 noon. (If there are no guests arriving immediately after, late check-out is possible). Upon arrival at the rental property at the time specified in the rental agreement, the Customer will be required to present their Booking Confirmation and proof of identity. The number and identities of the persons arriving must correspond to the list provided at the time of booking.
Security deposit
The Customer undertakes to take all necessary measures to ensure that the occupants respect the premises made available to them. These must be left as clean as they were on arrival. The principle of respect for property must prevail, in particular respect for the decorative elements left in place by Vivement Marrakech!
A non-cashable deposit of €500 must be provided by credit card imprint or in cash to the lessor's representative upon entering the villa. The deposit will not be cashed and will be returned provided that no damage has been found. Otherwise, the deposit will be cashed and refunded by bank transfer after deduction of the cost of repairs.

Occupants
Only the persons specified in the contract at the time of booking may occupy the villa, unless expressly requested and agreed in advance by the lessor or their representative. Any person not declared on the rental contract will not be allowed access to the villa, day or night, unless expressly agreed by Vivement Marrakech! or their representative.

Use of the property
The Customer expressly undertakes to use the property made available to them in a peaceful manner and to return it in the condition in which they received it. The Tenant undertakes to read and comply with the rules and regulations established by Vivement Marrakech! concerning the use of the house and its equipment.
The Customer may not assign the rental contract or sublet the accommodation. The Customer shall be personally and fully liable to Vivement Marrakech!, third parties and any third parties for all harmful consequences resulting from their actions and those of persons brought into the property.
The property is intended exclusively for private tourist or holiday accommodation. Any commercial or professional activity by the Customer is strictly prohibited on the premises and its surroundings throughout the duration of the stay, including, in particular, receptions of any kind, film shoots and photo shoots. It is also strictly forbidden to organise meetings, parties and other events of any kind inside the property or in the gardens of the property without the prior consent of Vivement Marrakech!
The Customer must respect the rules of good neighbourliness, particularly in terms of noise pollution beyond normal hours. As such, no loud noise should be made outside after 1 a.m. Use of the kitchen is strictly reserved for the property's staff.

Safety - Equipment
Parents shall be responsible for the safety of their children in general. The Customer uses the swimming pools, sports and wellness facilities of the Dar Layyina property under their sole responsibility. The Customer undertakes to comply with the rules set by Vivement Marrakech! or given verbally by the house staff for the use of these facilities.
It should be noted that the swimming pool is not equipped with a safety system or protective barrier, as these facilities are not mandatory in Morocco. It is therefore the sole responsibility of parents to supervise their children at all times and to protect themselves from the risk of drowning.
In the spa areas and spa and wellness facilities, the following actions are strictly prohibited: running; diving or jumping into the swimming pool, jacuzzi or hot tub; drinking alcohol or being under the influence of alcohol or drugs; leaving children unattended. In the event that the customer fails to comply with the safety instructions, Vivement Marrakech! or its representative may prohibit the use of the swimming pools or wellness facilities.
Vivement Marrakech ! cannot be held liable under any circumstances for accidents or bodily injury, material damage or immaterial damage to any person as a result of the presence of a swimming pool or any other sports or leisure facilities, including a hammam. Guests are expressly prohibited from tampering with the technical installations of these sports or leisure facilities. Only Vivement Marrakech! staff or its service providers are authorised to do so.
Vivement Marrakech! cannot under any circumstances be held liable for any theft or damage to property, any criminal act or any assault of which the Guest may be the perpetrator or victim on the property.

Energy
Vivement Marrakech! cannot be held responsible for any irregularities or lack of enjoyment that may occur in the electricity or internet services. Please note that the water supply depends on the electricity supply. Tap water is not recommended for consumption.
The Customer shall ensure that the lighting, heating and air conditioning systems are used in a normal and reasonable manner.
House staff
During the stay, house staff are at the Customer's service every day from 8 a.m. to 11 p.m. with breaks during the day.
Meal times:
- Lunch: 12 p.m. to 2 p.m.
- Dinner: 7 p.m. to 9 p.m.
Menus must be chosen the day before.
The Client may purchase alcohol and wine for consumption at the villa.
The gardener is present every day except Sunday. He maintains the garden and swimming pool.
The Client is therefore not required to handle the technical installations. In the event of a significant problem, he shall notify Vivement Marrakech! or its representative.

Moroccan laws
Any consumption of drugs or prostitution services or prostitution activity is strictly prohibited by Moroccan law and severely punished. It is particularly important to note that any relationship between a foreigner and a Moroccan man or woman outside of marriage, whether paid or not, is prohibited by law, severely punished and punishable by imprisonment.
If a representative of Vivement Marrakech! observes any activity or behaviour that does not comply with these general terms and conditions and the rules and regulations established by Vivement Marrakech! at or near the place of stay, this will result in the immediate cancellation of the contract without notice and without prejudice to the Customer, and the Customer's expulsion from the property, even before the end of the stay, without compensation.

Intellectual property
The Customer is authorised to take photographs on the premises of the Dar Layyina property, but has no right to commercially exploit or publish these photographs on any medium whatsoever.
Data protection
Vivement Marrakech! undertakes not to disclose its Clients' personal information, with the exception of information necessary for the processing, payment or cancellation of the booking.

Applicable law
These General Terms and Conditions and the stays provided shall be subject to Moroccan law. In the event of a dispute, an amicable solution shall be sought as a matter of priority. Failing this, the courts of Marrakech (Morocco) shall have exclusive jurisdiction. In the event of a contradiction between different versions of the general terms and conditions of sale, the version available on the website www.darlayyina.com shall prevail.
